End-User License Agreement (EULA)

Handitrax is a service of PHM Enterprises LLC. References to either name in this Agreement refer to the same business.
1. License Grant
Handitrax grants you a limited, non-exclusive, non-transferable license to use this application for your business operations, subject to the terms and conditions of this Agreement.
2. Restrictions
You may not:
- Reverse engineer, decompile, or disassemble the application
- Rent, lease, or lend the application
- Transfer or assign your rights under this license
- Use the application for any illegal purpose
- Attempt to gain unauthorized access to systems or data
3. Intellectual Property
All content, features, and functionality of Handitrax are owned by PHM Enterprises LLC and protected by copyright and other intellectual property laws.
4. Disclaimer of Warranties
Handitrax is provided "AS IS" without warranties of any kind, express or implied. We do not warrant that the application will be error-free or uninterrupted.
5. Limitation of Liability
In no event shall PHM Enterprises LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.
6. Termination
This license is effective until terminated. Your rights automatically terminate if you violate any terms of this Agreement.
7. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any dispute will be handled in the state or federal courts located in Pinellas County, Florida.
8. Subscriptions and Billing
Paid plans are billed by PHM Software, a registered trade name of PHM Enterprises LLC, under the subscription and billing terms at phmsoftware.com/terms. Subscriptions bought inside an iPhone or iPad app are billed by Apple under Apple's terms.
9. SMS Messaging Program
Handitrax operates an SMS messaging program with two kinds of transactional messages: (1) one-time passcodes (OTP), login verification codes and password-reset codes for account authentication; and (2) service notifications that businesses using Handitrax send to their own customers about work those customers requested — a link to view a quote, an invoice or payment link, an account statement, and appointment confirmations or cancellations. Each notification names the business it is from and is sent via Handitrax. No marketing or promotional SMS messages are sent.
App users opt in by providing a mobile number and checking the SMS consent box during account signup or in account settings. Customers of those businesses opt in by giving their mobile number to the business and agreeing to text updates when requesting a quote, booking service, or at service intake; the business records that consent before any text is sent. Consent is not a condition of purchase. Message frequency varies with account and service activity. Standard message and data rates from your mobile carrier may apply.
